1. OVERVIEW

Welcome to Wenscarlo.

These Terms of Service ("Terms") govern your access to and use of our website, https://Wenscarlo.store, and the purchase of products offered through our online store.

Throughout these Terms, the words "we", "us" and "our" refer to Wenscarlo. The words "you", "your" and "customer" refer to any individual accessing our website or purchasing our products.

Wenscarlo specialises in men's casual luxury clothing, footwear and accessories.

By accessing our website or placing an order, you agree to these Terms, subject to your statutory rights under applicable United Kingdom law.

Please read these Terms carefully before using our website.

Nothing in these Terms excludes, restricts or limits any consumer rights that cannot lawfully be excluded.

2. ELIGIBILITY AND WEBSITE USE

By using our website, you confirm that you are legally capable of entering into a binding contract or have obtained any necessary consent from a parent or legal guardian.

You agree to use our website only for lawful purposes.

You must not:

  • Use our website for fraudulent or unlawful activities.

  • Attempt to gain unauthorised access to our systems.

  • Distribute malicious software, viruses or harmful code.

  • Interfere with the security or functionality of our website.

  • Provide false or misleading information when placing an order.

  • Infringe the intellectual property rights of Wenscarlo or third parties.

  • Use automated systems to disrupt or overload our services.

We reserve the right to restrict access where reasonably necessary to prevent fraud, protect our systems or comply with applicable law.

3. PRODUCT INFORMATION

Wenscarlo aims to provide accurate descriptions, photographs, sizing information and specifications for all products displayed on our website.

We make reasonable efforts to ensure that product information is clear, accurate and up to date.

However, slight variations in colour may occur due to differences in screen settings, lighting and display technology.

Such variations do not affect your statutory rights where products are not as described or fail to meet applicable legal standards.

All products sold by Wenscarlo must comply with the requirements of the Consumer Rights Act 2015, including being:

  • Of satisfactory quality.

  • Fit for their intended purpose.

  • As described.

  • Consistent with any applicable sample or model.

We reserve the right to update product descriptions, availability and specifications, provided that changes do not unlawfully affect existing contracts.

4. PRICES AND PAYMENT

All prices displayed on our website for UK customers are presented in British Pounds Sterling (GBP, £).

Where applicable, prices will include VAT and other mandatory taxes, unless clearly and lawfully stated otherwise.

Any applicable delivery charges or other additional costs will be clearly communicated before you complete your purchase.

We do not impose hidden charges.

Payment must be completed using one of the payment methods available at checkout.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

Payments are processed through secure third-party payment providers.

We reserve the right to correct genuine pricing errors. If an error affects an order that has already been placed, we will contact you and explain the available options.

We will not charge a higher price without your express agreement.

5. ORDERS AND CONTRACT FORMATION

When you place an order through our website, you are submitting an offer to purchase the selected products.

After placing an order, you will normally receive an email acknowledging receipt.

An order acknowledgement does not necessarily constitute acceptance of your offer.

A binding contract is formed when we expressly accept your order, normally by sending an order acceptance or dispatch confirmation, unless otherwise stated during checkout.

We reserve the right to decline an order for legitimate reasons, including:

  • Product unavailability.

  • Suspected fraudulent activity.

  • Payment authorisation failure.

  • Material errors in product or pricing information.

  • Legal or regulatory restrictions.

Where payment has already been collected for an order that we do not accept, we will arrange a refund without undue delay.

We will not cancel accepted orders arbitrarily or in a manner that infringes your statutory rights.

6. PRODUCT AVAILABILITY

All products are subject to availability.

We aim to maintain accurate stock information, but availability may change.

If an ordered product becomes unavailable, we will notify you as soon as reasonably possible.

Where we cannot fulfil an accepted order, we will offer an appropriate remedy, including a refund where required.

We may introduce purchase quantity limits where reasonably necessary, provided that these are applied fairly and transparently.

7. SHIPPING AND DELIVERY

Wenscarlo offers delivery options for customers in the United Kingdom.

Our available shipping services include:

Express Shipping

Estimated delivery time: 5–8 working days.

This is a paid delivery service. The applicable charge will be displayed at checkout.

Standard Shipping

Estimated delivery time: 5–12 working days.

This service is provided free of charge for eligible UK orders.

Delivery estimates are calculated in working days, excluding weekends and public holidays.

These estimates are not guaranteed delivery dates unless expressly agreed as such.

We will make reasonable efforts to deliver within the stated timeframe.

Under applicable UK consumer law, goods must generally be delivered without undue delay and, unless otherwise agreed, within 30 days after the contract is entered into.

If delivery is delayed, customers retain their rights under the Consumer Rights Act 2015.

Where the statutory conditions are satisfied, customers may be entitled to cancel their order and receive a refund.

Please refer to our Shipping Policy for further information.

8. DELIVERY RESPONSIBILITY AND RISK

Where Wenscarlo arranges delivery, responsibility for the goods generally remains with us until the products come into your physical possession or that of a person nominated by you to receive them.

If products are lost or damaged before delivery, we will provide an appropriate remedy in accordance with applicable consumer law.

If you independently arrange a carrier not offered by Wenscarlo, responsibility may transfer in accordance with the relevant statutory provisions.

Customers should provide accurate delivery information when placing an order.

If you discover an error in your delivery details, please contact our customer support team promptly.

9. RETURNS, REFUNDS AND CANCELLATIONS

Customers purchasing eligible products online generally have a statutory right to cancel their order within 14 days of receiving the goods, without giving a reason.

After notifying us of cancellation, customers generally have a further 14 days to return the products.

Refunds will be processed in accordance with the Consumer Contracts Regulations 2013 and our Return & Refund Policy.

Where an entire eligible order is cancelled, the original standard delivery charge will be refunded where required by law.

Additional charges for premium delivery services may not be refundable beyond the cost of the least expensive standard delivery option offered.

Products that are faulty, damaged, misdescribed or otherwise non-conforming remain subject to statutory remedies under the Consumer Rights Act 2015.

Please consult our Return & Refund Policy for complete information.

10. FAULTY OR MISDESCRIBED GOODS

Under the Consumer Rights Act 2015, consumers have legal rights when goods are faulty, not as described or not of satisfactory quality.

Depending on the circumstances, these rights may include:

  • A short-term right to reject qualifying goods, normally within 30 days.

  • A repair or replacement.

  • A price reduction.

  • A final right to reject and receive a refund.

The appropriate remedy depends on the nature of the problem and the applicable statutory requirements.

Nothing in these Terms limits these rights.

Where we are legally responsible for faulty or non-conforming goods, we will bear the necessary costs of providing the required remedy.

11. PROMOTIONS AND DISCOUNTS

Wenscarlo may occasionally offer promotional discounts, seasonal sales, bundle offers and special promotions.

Promotional terms will be communicated clearly where applicable.

Offers may be subject to stated eligibility requirements, availability and expiry dates.

We reserve the right to withdraw or amend promotional offers prospectively, provided that doing so does not unlawfully affect existing contracts.

Products purchased during promotional periods remain protected by applicable UK consumer legislation.

Discounted products are not automatically excluded from statutory cancellation, return or refund rights.

We aim to ensure that promotional pricing and advertising comply with applicable consumer protection and unfair commercial practices legislation.

12. CUSTOMER ACCOUNTS

Customers may be able to create an account to manage orders and access relevant services.

You are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate and current information.

If you suspect unauthorised access to your account, please notify us promptly.

We may suspend an account where reasonably necessary to investigate suspected fraud, security threats or serious breaches of these Terms.

Any action taken will be proportionate and consistent with applicable law.

Personal data collected through our website will be processed in accordance with applicable data protection legislation, including:

  • The UK General Data Protection Regulation (UK GDPR).

  • The Data Protection Act 2018.

  • The Privacy and Electronic Communications (EC Directive) Regulations 2003, where applicable.

Personal information may be processed for purposes such as:

  • Processing and fulfilling orders.

  • Managing payments.

  • Providing customer support.

  • Delivering products.

  • Preventing fraud.

  • Complying with legal obligations.

  • Sending marketing communications where permitted by law.

Further information about the collection, use, retention and protection of personal information will be provided in our Privacy Policy.

Where legally required, customers will be given appropriate choices regarding marketing communications and non-essential cookies.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, the Wenscarlo name, branding, logos, website design, original written content and other intellectual property owned by Wenscarlo are protected by applicable intellectual property laws.

You may access and use our website for lawful personal shopping purposes.

You must not reproduce, distribute, modify or commercially exploit protected content without the necessary permission or other lawful basis.

Nothing in these Terms restricts rights or exceptions provided under applicable copyright and intellectual property legislation.

Third-party trademarks and materials remain the property of their respective owners.

15. THIRD-PARTY SERVICES

Our website may use third-party services to support payments, website hosting, order processing, delivery and other operational functions.

These services may include e-commerce technology providers and payment processors.

Third-party services may be subject to their own terms and privacy notices.

Wenscarlo remains responsible for its contractual and statutory obligations to customers.

We do not exclude responsibility for matters for which we remain legally liable merely because a third-party service provider is involved.

16. WEBSITE AVAILABILITY

We aim to keep our website accessible, secure and functional.

However, temporary interruptions may occur due to maintenance, technical problems, security updates or circumstances beyond our reasonable control.

We may update, maintain or modify website functionality where reasonably necessary.

Nothing in this section excludes liability or remedies that cannot lawfully be excluded.

17. PROHIBITED CONDUCT

You must not use our website to:

  • Commit fraud or facilitate unlawful transactions.

  • Violate applicable laws or regulations.

  • Infringe the rights of other individuals or organisations.

  • Upload or distribute malicious software.

  • Attempt unauthorised access to customer information.

  • Interfere with payment or security systems.

  • Misrepresent your identity in connection with fraudulent activity.

  • Engage in conduct intended to disrupt our services.

We may take reasonable and lawful action in response to prohibited conduct.

18. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Breach of statutory consumer rights where liability cannot lawfully be excluded.

  • Any other matter for which exclusion or limitation of liability is prohibited by law.

We are responsible for losses that are a foreseeable consequence of our breach of contract or failure to exercise reasonable care and skill, subject to applicable law.

We do not seek to exclude liability for losses where doing so would be unfair or unlawful under the Consumer Rights Act 2015.

Where products are purchased for personal consumer use, these Terms do not seek to remove the protections available to consumers under UK law.

19. EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delays or failures caused by events genuinely outside our reasonable control to the extent permitted by applicable law.

Such events may include severe weather, natural disasters, major transport disruption or significant infrastructure failures.

Where an event affects our ability to fulfil an order, we will take reasonable steps to notify affected customers and minimise disruption.

Customers will retain any statutory rights to cancellation, refunds or other remedies.

20. COMPLAINTS AND CUSTOMER SUPPORT

We aim to resolve customer enquiries and complaints fairly and promptly.

If you experience a problem with an order, product, delivery or service, please contact:

Website: https://Wenscarlo.store

Please include your order number and relevant details where possible.

We will investigate complaints and seek an appropriate resolution.

Customers may also obtain independent consumer advice or pursue remedies available under applicable law.

21. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the customer's place of residence.

Consumers residing in Scotland or Northern Ireland retain the protections and rights provided by applicable law.

Nothing in these Terms prevents consumers from bringing proceedings before a court that has jurisdiction under applicable law.

We do not require consumers to surrender statutory rights or accept an unlawful restriction on their ability to seek legal remedies.

22. CHANGES TO THESE TERMS

Wenscarlo may update these Terms to reflect changes in legislation, business operations, website functionality or customer service procedures.

Updated Terms will be published on our website.

Changes will not retrospectively remove statutory rights or unlawfully alter contracts already formed.

The Terms applicable to a purchase will generally be those in force when the relevant contract was formed, unless a lawful variation is agreed.

23. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

Any unenforceable provision will not affect the validity of the remaining Terms.

24. ENTIRE AGREEMENT

These Terms, together with the applicable product information, order confirmation, Return & Refund Policy, Shipping Policy and other expressly incorporated contractual information, form the basis of the agreement between Wenscarlo and the customer.

Nothing in this section excludes liability for misrepresentation or restricts statutory rights.

Any mandatory pre-contractual information incorporated into the contract under applicable law remains binding.
